Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the eSIM PINK mobile application (the "Service") operated by Nous Ventures ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.

1. Use of the Service

a. You must be at least 18 years old to use the Service.

b. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your devices.

c. You agree to accept responsibility for all activities that occur under your account or password.

2. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Nous Ventures and its licensors.

3. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

4. Charges and Payment

4.1. Payment Conditions

The supported payment methods for eSIM PINK services are Credit/Debit Card, PayPal, Google Pay, Apple Pay, and Alipay.

The currency of payment is in US Dollars($).

The credit card transaction will be processed and secured by our providers PayPal (https://paypal.com) and Stripe (https://stripe.com).

4.2. Charges for Use

4.2.1. Nous Ventures states all Charges are inclusive of VAT unless otherwise specified.

4.2.2. The Customer shall not be entitled to offset any of its claims against claims of Nous Ventures, except where the Customer's claims are undisputed or have been confirmed by final court judgment.

5. Delivery

The Customer will immediately see the purchased eSIM under the "My eSIMs" tab on their eSIM PINK account. The Customer will receive a confirmation email after the purchase. All the information for installing the eSIM will be available only on the user's eSIM PINK account.

6. Refund / Cancellation / Modification Policy

The Customer has the right to ask for a refund or eSIM-replacement if the eSIM cannot be installed and used due to a technical problem from eSIM PINK.

6.1. Refunds and Cancellation

6.1.1. Policies and Guidelines

- A refund request can be made within thirty (30) days from the date of purchase when the activation is no longer possible following extensive collaborative troubleshooting.

- Cooperation with the Customer to resolve the issue promptly is required for a refund to be granted.

- Each data package has its own validity period. No refund of any form will be offered for the remaining data when the validity period expires.

- Compensation: No refund or remuneration of any kind will be issued due to charges from alternate phones, alternate SIM cards, alternate providers, hotel phones, or other charges that are not directly linked to the Customer's eSIM PINK account.

- Fraudulent purchases: Nous Ventures reserves the right to refuse any form of refund if there is evidence of abuse, violation of our Terms and Conditions, or any fraudulent activity connected with using eSIM PINK products and services.

- Unauthorized purchases: The case will be subject to investigation and approval before processing any refund. Nous Ventures reserves the right to suspend any account associated with fraudulent activity.

- Accidental purchases: Once Customers install the eSIM, it will be considered used. No refunds will be offered.

- Incorrect charges: If the Customer reasonably and in good faith disputes an invoice or part of it, the Customer shall notify Nous Ventures of such a dispute within twelve (12) days of receipt of the invoice, providing details of why the invoiced amount is incorrect and, if possible, how much the Customer considers due.

- Other Reasons: If the refund request is not within the above, we will investigate the request on a case-by-case basis. If the refund is approved, a processing fee may apply. The maximum refund of credit a Customer can apply for must be equal to or less than the total amount they paid.

6.2. Modification

The eSIM data packages from eSIM PINK are offered as-is, and no further modifications or customization can be made based on individual requests once purchased.

7. Limitation of Liability

In no event shall Nous Ventures, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Nous Ventures is not responsible for detriments arising due to the proposed service not being constantly available. Nous Ventures provides no guarantee of constant availability of the network service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of New Mexico, without regard to its conflict of law provisions.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
